How much is my car accident case worth in Texas?

The short answer

No one can give you an honest number in the first week. A Texas car accident case is generally worth what you can prove you lost, reduced by your share of the fault and limited by the insurance or other money that can actually be collected. That depends on your medical care, your lost income, how serious the injury is, the coverage available and who was at fault.

What can you claim after a Texas car accident?

Texas law recognizes two main kinds of damages when another driver's negligence hurts you. You may recover them when the evidence supports them. Nothing on this list is automatic.

  • Economic damages are losses with a paper trail: medical care, future medical care, lost wages, lost earning capacity and damage to your vehicle.
  • Non-economic damages are real losses without a receipt: physical pain, mental anguish, physical impairment and disfigurement.

Texas generally does not cap pain-and-suffering damages in an ordinary car crash claim against a private defendant. Different limits may apply to claims against government entities and to other special categories of claims (CPRC §101.023).

What about punitive damages?

Punitive damages, which Texas calls exemplary damages, may be available when clear and convincing evidence shows the harm resulted from fraud, malice or gross negligence. Drunk driving or street racing does not automatically establish that right. A jury must agree unanimously on liability and the amount, and statutory caps usually apply, with exceptions that include certain intoxication-related felonies (CPRC §§41.003, 41.008).

What decides the value of a car accident case?

Your medical bills, but only what was paid or is still owed

For past medical care, recovery is limited to reasonable, necessary charges actually paid or still legally owed by you or someone acting for you. Charges written off so that no one must pay them are excluded (CPRC §41.0105; Haygood v. De Escabedo).

Your lost income and earning capacity

Wages you missed while recovering can usually be shown with pay stubs or a letter from your employer. If an injury reduces your ability to earn a living, you may also claim compensation for that loss over your expected remaining working years. The amount depends on evidence of what you could do before and after the injury, the work available to you and how long the loss is likely to last (W & T Offshore v. Fredieu).

How serious and lasting the injury is

A sprain that heals in weeks and a disc injury that needs surgery are different cases, even when the crash looked the same. The diagnosis, the length of treatment and whether the injury is permanent all shape the claim. Until your doctors understand the injury, its full cost is unknown, which is why an early number is usually a guess.

How much insurance is available

Insurance often sets the practical limit on what can be collected. These are the minimum liability limits Texas requires. They are coverage minimums, not limits on the damages a person may prove (Transportation Code §601.072).

Texas minimum auto liability limits
CoverageMinimum
Injury or death, one person$30,000
Injury or death, per crash$60,000
Property damage, per crash$25,000

Your own underinsured motorist (UIM) and personal injury protection (PIP) coverage may help, depending on your insured status, your policy's terms and limits, and the facts. Texas auto liability policies must include these coverages unless an insured named in the policy validly rejects them in writing, and a prior rejection may carry forward to a renewal or reinstatement (Insurance Code §§1952.101, 1952.152).

Your share of the fault

In a Texas crash claim governed by proportionate responsibility, you cannot recover damages if you are more than 50% responsible for the harm. At 50% or less, your damages are reduced by your share of responsibility, and other adjustments such as settlement credits may also apply (CPRC §§33.001, 33.012). That is why it matters what you say about the crash, including in a recorded statement.

Can an online settlement calculator tell me what my case is worth?

No. A calculator that multiplies your medical bills cannot see the things that decide a real case: which bills count under the paid-or-owed rule, the policy limits, the fault split, or what the evidence shows. Treat any number it gives you as entertainment, not advice.

Some insurers use software to help evaluate injury claims. A software estimate does not itself establish the amount you are legally entitled to recover.

What can lower or strengthen a claim?

These can hurt

  • Waiting days or weeks to see a doctor after the crash
  • Gaps in treatment or skipped appointments
  • Statements about the crash or your injuries that turn out to be incomplete
  • Posts about the crash or your activities on social media
  • Signing a release before you understand the injury. A valid injury release may prevent a later claim even if treatment turns out to be more extensive than expected.
  • Missing a deadline. Most Texas injury lawsuits must be filed within two years, with exceptions, and government claims can require notice much sooner (CPRC §16.003).

These can help

  • Prompt medical care and a clear record connecting the injury to the crash
  • The crash report, checked for errors
  • Photographs, witness names and video, gathered before they disappear
  • Following your treatment plan and keeping your bills and records together
  • Knowing every policy that might apply before you respond to an offer

When you compare settling with going to court, weigh the evidence, the law, the costs and the risks of taking the case to trial. An attorney may help you evaluate those things, along with the coverage and the settlement terms. Whether to hire one depends on the circumstances, and representation does not guarantee a particular recovery.

Questions people also ask

Is there an average settlement for a car accident in Texas?

Not one you can rely on. Published averages mix minor fender-benders with catastrophic injuries, and they say nothing about your injuries, your coverage or the fault in your crash.

Does the insurance company have to pay my full medical bills?

Not automatically. Recovery for past medical care is limited to reasonable, necessary charges actually paid or still legally owed. Amounts written off so that no one must pay them are excluded.

Can I still recover if I was partly at fault?

Yes, if you were 50% responsible or less. Your damages are reduced by your share of responsibility. At more than 50%, you cannot recover damages on that claim.

What if the other driver only has minimum coverage?

Your own underinsured motorist coverage and personal injury protection may help, depending on your policy and the facts. Texas policies must include these coverages unless an insured named in the policy validly rejected them in writing.

Can a lawyer tell me what my case is worth on the first call?

A lawyer can explain what will decide the value and what to do next, but a fair number depends on facts that usually aren't known yet, like your treatment and the available insurance. Be wary of anyone who promises a figure.
